AUSTIN — Texas doctors who perform abortions without parental approval or after the third trimester could face capital murder charges because of a new law that takes effect this week, a prosecutors group says.
The Texas District and County Attorneys Association has outlined that scenario in its new book updating the Texas penal code and in public presentations around the state. The group says such charges could occur under the new law because of the 2003 fetal protection law. But key legislators said today that wasn’t their intent.
Good. If abortion is murder, not only should doctors be prosecuted, so should the women who have them. And the chances of those laws staying on the books as doctors, wives, sisters and daughters are sent off to Death Row? Slim to none.
Because this is an elaborate charade. The right wing calls it murder because it fires up the base. Once their bluff is called, they’ll scurry like the rats they are.


I agree with your disgust at the law, etc, but as far as this goes:

I wouldn’t bet the farm on this. Most of us thought that, for instance, no Texas Governor would dare be so publicly heartless that he’d allow the mentally handicapped to be executed.
So, not only might the laws stay on the books, they might set up bleachers and sell admission to the executions.

I loved this one Susie. If the rest of the country only knew that in Texas women are treated more like property than they are people. Just ask cause I was there too. You have a cousin that his wife will be more that happy to tell you the real facts of a woman’s life in Texas.
As for the laws disappearing off the books, I love it when people start telling Tex Ass jokes. Just John is right, it will be the biggest selling tickets in town.
The easy answer to this Texas conundrum is obvious: prosecute the doctors, of course, as the actors in this crime, and prosecute the women as co-conspirators. But also prosecute the fathers, as co-conspirators.
As soon as the lunatics see that the Sacred Phallus must also be held to account for this crime of “fetus murder” it’ll be gone from eyesight like that red headed left-handed stepchild.

This really is the sticky issue for people who lean on the “it’s a baby, not a choice” argument because they know that simply coming right out and saying pregnancy is god’s punishment for Eve’s sin isn’t really going to fly in the modern era–it’s terribly unjust to sentence someone to death for crimes against the patriarchy, but if you’re arguing that they are killing babies, you’re kind of stuck advocating for unjust punishments. Same story with the way so many anti-choicers have their heads up their asses about what the actual result would be if they make abortion illegal–women will start going to jail for having abortions, and it’s even quite likely that ordinary miscarriages that are essentially cleaned up by the doctor so women don’t get infections will be subject to criminal investigations. I keep thinking of the Elaine on Seinfeld commenting on men’s penises: “I don’t know how you guys walk around with those things.” I don’t know how you girls (women) walk around with those uteruses sometimes. You’ve been blamed for original sin for 2000 years. males attempt to control how you live your life. and in some countries it’s so much worse for women (and so well known by now) i don’t even want to talk about it. maybe it should be talked about. chinese female babies being found in dumpsters, young girls getting circumsized… and yet some american women are quite content in their roles as subserviant to men. it’s all so interesting and complex. but it is 2am after all.
