Are these folks too into the DC cocktail circuit to see this?  I'm only a wee elected person and I could see the benefits to sailing as far away from Bush as possible.</description>

no, executive orders are law, although they are "weaker" in force than a constitutional provision or statute. any EO that is contrary to the constitution or a statute is not valid. which means that a lot of bush's EOs are probably invalid anyway. but until a court rules them invalid they will be enforced and can do a lot of damage. on the other hand, ron is right that EOs can be overruled by subsequent EOs.

If Obama really wants to differentiate himself from Hillary -- and ask for my vote, too* -- he can filibuster on the Senate floor, with Dodd, against the FISA abomination -- as he could have done before. That would be something to do &lt;i&gt;now&lt;/i&gt;, not at a distant point in the future. I've argued for a long time that this would be a game-changer for Obama, the right thing to do, and the smart thing to do. I don't expect it. Leaders lead.
