Inciting to Riot

“We do, hopefully, the right thing for the sake of this country. We’re the only one in charge of our affairs. We don’t farm out our defense if we elect Democrats … and riots in Denver, at the Democratic Convention will see to it we don’t elect Democrats. And that’s the best damn thing that can happen to this country, as far as I can think,” Limbaugh said.
Is this enough to file charges?
Under federal law, a riot is a public disturbance involving an act of violence by one or more persons who are assembled in a group of at least three people. The act of violence must be one that presents a clear and present danger of injury to another person or damage to another person’s property. Threatening to commit a violent act in such a group situation that could injure another person or damage property is also considered a riot if one of the persons in the group has the ability at the time to carry out the threatened violence.
Inciting a riot applies to a person who organizes, encourages, or participates in a riot. It can apply to one who urges or instigates others to riot. It does not apply to someone who merely advocates ideas or expresses beliefs, if those ideas and beliefs do not involve advocating violence.
The federal crime of inciting a riot carries a possible penalty of up to five years in prison a fine.
UPDATE: Richard Blair says we should complain to the Colorado Attorney General:
…and you should be urging Colorado Attorney General John Suthers to investigate. How is it that a GOP attack dog frontman can call for riots in the streets of Denver during the Democratic National Convention, and not be currently residing in a jail cell someplace? Because, apparently, IOKIYAR. Still, Inciting to Riot is a felony - and the Colorado AG should be all over this.

I hope that this doesn’t end up as some sort of contelpro project–i.e. Republicans disguised as democrats provoking a riot in Denver during the convention. A riot would certainly serve the GOP agenda, and the media’s.
Take it from me, Republicans would rather die and go to hell than be mistaken for a dweeb democrat.
And Susie- just the other day, you made a post about a friend of yours who predicted/ wondered if McCain was going to be shot for some devious reason. Based on that warped thinking, your friend could not be more f-ed up and insecure and angry.
Sure Rethugs would pose as unruly Dems to smear the party. Even more likely that they’d hire people to do the dirty. If you read your history, it’s actually SOP for them.
And I would be a little concerned to see if they bring on Blackwater to serve as security. I may becoming paranoid but I secretly think of a coup with this group.
Ooh, another Brooks Brothers riot?
More likely than infiltrators are outside agitators to get demonstrators riled up.
actually, a friend was telling me on election night that there are a variety of lefty groups planning to protest the dem convention and that their motto is a riff on “bringing 68 to 08″ or some such nonsense.
why any protest group would show up in denver rather than minneapolis–unless HRC carries out her plan to steal the nomination at the convention of course–is beyond comprehension.
“There won’t be riots at our convention,” Limbaugh said of the Republican National Convention. “We don’t riot. We don’t burn our cars. We don’t burn down our houses. We don’t kill our children. We don’t do half the things the American left does.”
He really should have made it clear that “we” don’t do it in our own country.
And Wendy - wasn’t that post the other day referring to McCain setting himself up to be shot to gain a political advantage? Although perhaps publishing such musings could or should be seen as advocating it.
It’s nonsense to think that McCain would be subject to violence.
But it DOES make sense to be concerned that he’s going to “stroke out” before Jan 20th; the guy is so old that he shouldn’t be buying green bananas, let alone running for president.
First, it was Rush’s usual inane rambling and thus difficult to break down properly but when he said “…that’s the best damn thing that can happen to this country…” he could just has easily have been referring to “will see to it we don’t elect Democrats” as “…riots in Denver…” and frankly, a first year law student could handle the case and have it thrown out of court in about 10 seconds based on that alone.
Second, what ever happened to free speech? I loathe Limbaugh but will defend his right to speak. Not liking his politics is no reason to grasp at straws and try to bring him - and the First Amendment - down.
And don’t bother arguing about “fire in a movie theater” - Limbaugh was clearly making a political point - the exact discourse the First Amendment was written to protect. Fight Limbaugh with logic and facts – not suppression of free speech.
unless HRC carries out her plan to steal the nomination at the convention of course
You know, perpetuating the lie that the nomination is Obama’s and that the only way that Clinton could possibly win is to “steal” it does not really help with the riot scenario.
It takes about two (TWO) minutes to file a complaint. Just go to the FCC and follow the links. It is a piece of cake. Go do it.

Yeah, really, all this talk abuot more votes and more delegates somehow equalling his earning the nomination is nothing more than the delusional rantings of Obamaniacs. Clinton has received more votes from “the right kind of people” and that’s what really matters.
As I recall, didn’t Rev. Al Sharpton, months ago, that if Obama lost the nomination, there would be riots in Denver? This was mentioned back in Jan. ‘08.
