This is one of the reasons why I support Obama over Clinton (though I would vote for Clinton if she got the nomination).

I have been thinking all along that these dictates of the chimperor could be removed by a simple executive order. The next President needs to start by removing the odious and illegal change in FOIA

From what I understand, that’s only true of some of them. Others are a lot more complicated.
Speeches are great, but fine words butter no parsnips. If Obama really wants to differentiate himself from Hillary — and ask for my vote, too* — he can filibuster on the Senate floor, with Dodd, against the FISA abomination — as he could have done before. That would be something to do now, not at a distant point in the future. I’ve argued for a long time that this would be a game-changer for Obama, the right thing to do, and the smart thing to do. I don’t expect it. Leaders lead.
*Then we could talk about universal health care and Social Security.

Executive Orders are Executive Branch policy. They are not law and may be amended or rescinded by any subsequent executive order. Trouble is where you gonna find copies of all those signin’ statements and EO’s. BushCo’s attack on america has been so widespread and exhaustive, whoever the next president is, they’re going to need to rebuild the morale of the entire executive branch just to start. Can you say Office of Constitutional Restoration?

no, executive orders are law, although they are “weaker” in force than a constitutional provision or statute. any EO that is contrary to the constitution or a statute is not valid. which means that a lot of bush’s EOs are probably invalid anyway. but until a court rules them invalid they will be enforced and can do a lot of damage. on the other hand, ron is right that EOs can be overruled by subsequent EOs.
Trouble is where you gonna find copies of all those signin’ statements and EO’s.
the EOs are reported in the federal register. you can look them up now. just start with the january 2001 volume and work forward from there.
there can be secret EOs that are not reported because they are classified. but any future president would have access to them. besides, EOs are an order of the president to the executive branch bureaucracy to take certain actions. if no one in the oval office can find the order, the order won’t go out to the newly appointed federal bureaucracy to enforce what they say.
Wasn’t it the Boston Globe that had all the info on the signing statements? Whichever paper, they could just print up copies of their research. Easy peazy.
You’d think the pols would read polls. Bush is totally toilet and the easiest way to get elected is to trash his legacy. Are these folks too into the DC cocktail circuit to see this? I’m only a wee elected person and I could see the benefits to sailing as far away from Bush as possible.
