I am a retired criminal defense attorney. I have posted before that the probable cause element of this search of Weiner’s laptop was driven by his criminal behavior on- line with a minor. They searched for his penis photos after obtaining a warrant. If you think that they were somehow limited by metadata and captions to just the re:lines that said: ” here Baby look at my load,” you are damned naive. The subsidiary filing here was to cover political sabotage. If this actually involved probable cause for a second warrant, there would be detail of the incident captures on the first that lead to the second.
My understanding is that much of the classified information in the emails was determined to be classifiable after the emails were sent. So it would be easy to get a nameless faceless odorless Bush-era deadender in one of the intelligence agencies to retroactively classify something in the emails to create a problem for Clinton.
No surprise here. The FBI should change its name to RBI (R for Russian or Republican interchangeably). Quite a coup by Russian/Republican enemy combatants, sabotage an American election putting your puppets in power and completely discredit an entire American agency in one action.
I also thought it was odd that they redacted information on the agent asking for the warrant.
Maybe we should do to the FBI what they’ve done to the ATF.
