Fruit of the poisoned tree

Trump pushes back on report that he spoke about rescinding Gorsuch's Supreme Court nomination

Josh Marshall:

There are plenty of others who can give you smarter and more knowledgable takes on the Janus decision. It’s terrible. As Justice Kagan says, it’s weaponizing the First Amendment, a new interstate commerce clause, only for power rather than rights. The only very mild saving grace in the Janus decision is that labor saw this coming a mile away and they’ve had time to prepare as much as possible. There’s not a lot they can do but there are steps to mitigate the damage.

The decision itself is the purest form of right wing judicial activism and illegitimate because it relies on the corrupt appointment of Justice Gorsuch.

  1. The US Supreme Court’s only real function is to prevent a civil war by maintaining a certain societal equilibrium.

The Court failed in that duty in 1856, when it issued the Dred Scott Decision claiming that “Negroes” had no rights and never would have.

Chief Justice Taney wrote, “We think they (Negroes) are not, and that they are not included, and were not intended to be included under the word “citizen” in the Constitution….”

It doesn’t matter who Trump nominates to the Supreme Court.
What matters is how the Democrats respond to Trump and the Republicans in November at the polls.

First of all, no Democrat, not a single one, should vote to confirm anyone Trump nominates.
    Unless it’s Hillary or Bernie.
This is a litmus test for all Democrats.

Secondly, we need to eliminate the Republican scourge by voting in massive numbers on November 6.
We must take back the US House, US Senate and every statehouse across the country from the Republicans.

    Republicans are the enemy.

  2. There is more poisoned fruit to come. Next they will find state action in the NLRA and extend the judicially manufactured “Right to Work” First Amendment to all private employers.
