Why is anybody surprised when this originalist and member of the Federalist Society reads the law in a way that any strict constructionist would?
All of these clowns are convinced, or at least they claim they are in public, that the Constitution is a static document that can only be interpreted in one way.
Just like the Bible.
Which is why Roman Catholics and Evangelical Christians are the only judges acceptable to the extremist Right.
This is way out there! A few examples of things the States could do away with: the Establishment Clause, jury trial, double jeopardy, public defenders, free speech… anything in the Bill of Rights that did not expressly extend to the States. But, of course, it was these same stalwart geniuses that determined the Fourteenth and Fifteenth Amendments were from enactment intended to confer personhood on corporations. I believe that Thomas’ navel gazing on these subjects is impeachable.
