It very well could be. Whales migrate all over the oceans following paths built into their DNA. Construction at points along that path has a high probability of disturbing their migration. Such an event may alter feeding patterns or redirect the animal into the path of new hazards. If the development is within US territorial waters, the government has the ability to regulate.
